This Personal Online Banking Agreement
(Agreement) contains the terms and conditions that govern your
personal to information, accounts, internal transfers and other
online services. You may use an Internet Service Provider to
access Eligible Accounts, as defined in the Accessing Personal
Online Banking section of this Agreement.
By using the First National Bank (FNB)
Personal Online Banking service you agree to abide by the terms
and conditions of this Agreement.
Terms
and Conditions
Changes
Except as otherwise required by law, rule, or
regulations, FNB may change the terms and conditions of this Agreement
at any time. When changes are made to the Agreement they will be
made at the Web site. Changes will be effective the date the Web
site is updated unless the law, rule, or regulation requires advanced
notice, in which case the change will be effective in accordance with
the law, rule, or regulation. If changes result in an increase
in service charges, FNB will provide customers thirty (30) calendar
days notice of the change.
Customer Rights and Responsibilities
This Agreement does not supersede Corporate
Resolutions, Signature Card Rules and Regulations, Account
Disclosures, ACH Origination Agreement, Funds Transfer Agreement, or
any other Agreements customer may have with FNB. All Account
Agreements and Rules now or hereafter governing customer accounts will
remain in full force and effect after the execution of this Agreement.
You shall access only accounts at FNB held for personal use.
Bank’s Liability
Except as specifically provided in this Agreement
or where the law requires different standards, Customer agrees that
neither FNB nor its service providers shall be responsible for any
losses. Losses include profits or data, property damage or
bodily injury; whether caused by the equipment, software, FNB Internet
access providers, online service providers, or an agent or
subcontractor of any of the foregoing. Nor shall FNB or the
service providers be responsible for any direct, indirect, special or
consequential, economic or other damages arising in any way out of the
installation, use or maintenance of the equipment, software, online
services, Internet, or access thereof.
Customer Liability
Your liability for an unauthorized withdrawal,
transfer, or series of related unauthorized withdrawals or transfers
is detailed in the General Terms Section.
Access Codes
To use our online banking service, you must use the
access codes we establish or provide for you. Keep them
confidential to prevent unauthorized use or loss to your accounts.
Anyone to whom you give your access codes will have full access to
your accounts even if you attempt to limit that person’s authority.
Additionally, that person will have full access to any other of your
accounts which are accessed by those access codes, even if those
accounts are in your name with another person. None of our
employees or employee of our affiliates will contact you via phone or
e-mail requesting your access codes. If you are contacted by
anyone requesting this information, please contact us immediately at
our phone number shown in the top of the contract.
Protecting Your Personal Information
In addition to protecting your access codes, you
should also take precautions to protect your personal identification
information, such as your driver’s license, social security number or
tax identification number. This information by itself or
together with account information may allow unauthorized access to
your accounts. You should treat personal information with the
same level of care that you would for your account information.
You should also protect and secure all information and data stored in
any personal computer or other equipment you use to access our online
banking service.
Termination
Unless otherwise required by applicable
law, FNB may terminate this agreement and/or Customer access to any of
the online services through the Internet, in whole or in part, at any
time. Termination does not relieve Customer of its
responsibility for service charges accrued prior to termination.
Additionally, Customer must notify FNB ten (10) business days in
advance of its’ intention to close an account in which Customer has
access through Personal Online Banking.
NOTICES
UNLESS OTHERWISE REQUIRED BY APPLICABLE LAW, IN THE
EVENT THAT FNB IS REQUIRED TO PROVIDE NOTICE OR OTHER COMMUNICATION TO
CUSTOMER IN WRITING, SAID NOTICE OR COMMUNICATION MAY BE SENT TO
CUSTOMER BY E-MAIL AT YOUR INTERNET ADDRESS AS REFLECTED IN OUR THEN
CURRENT RECORDS. SIGNING THE CONSENT TO THIS AGREEMENT ALSO
PROVIDES YOUR CONSENT TO PROVIDE YOU WITH ELECTRONIC DISCLOSURES.
Disclosures
The circumstances under which we will disclose
information about Customer accounts on your online services is set
forth in our
Privacy Notice.
Accessing Personal Online Banking
Eligible Accounts
Each open and active FNB Personal Checking,
Savings, Certificate of Deposit or Loan account is eligible to be
accessed through Personal Online Banking.
Accounts The term “Accounts” means
any Demand Deposit, Savings, Certificate of Deposit or Loan Account at
FNB held by a particular Customer, and that is listed on Personal
Online Banking Application and/or Authorized Agent Forms.
Deposit Account The term “ Deposit
Account” means Demand Deposit, Savings or Certificate of Deposit
account at FNB which is used for personal purposes.
Loan Account the term “Loan Account” means a
loan or line of credit at FNB which was obtained for personal
purposes.
Posting Of Transactions
Although Customer will have 24 hour access to the
system, there are cut-off times for the posting of transactions.
Any internal transfer must be entered into the system by Customer
prior to 4:30 p.m. for the transfer to be posted on that same business
day. Any internal transfer entered into the system after 4:30
p.m. will be posted on the next business day
Stop Payments Customer may initiate a
stop payment on a single item or a range of items, and review the stop
payment status. FNB is only responsible for items stopped
exactly as described and will exercise reasonable care and efforts to
comply with the stop payment. FNB shall not be liable should
such item(s) be paid or cashed in any office on or prior to the date
and time of the stop payment. Customer must initiate a Stop
payment by 4:30 PM for the stop payment to be placed that same
business day. Any items after 4:30 PM will be placed on the
following business day. FNB shall provide Customer with written
confirmation of Personal Online Banking initiated stop payment(s) via
U.S. mail, at the address contained within the Personal Online Banking
Application. Personal Online Banking initiated stop payment(s)
shall be deemed authorized, unless FNB receives written dispute from
Customer prior to 14 calendar days after the initiation. Written
disputes should be mailed to:

Customer understands that the stop payment is in
effect for six months from the effective date hereof, and that
Customer must make written renewals if it wishes to extend the stop
payment(s) beyond the six month expiration
Maintenance Requests - Customer may
request additions or deletions to its’ accounts, Authorized Users, and
Transfers by contacting the bank to request and complete a Personal
Online Banking Maintenance form and returning the form to
First National Bank

Log In
To access Customer’s Eligible Accounts, Customer
will be required to complete a Personal Online Banking Application.
Please print, sign, and return the application to a FNB branch or send
it to the address provided in this section. FNB will send
Customer’s Authorized User(s) a letter in the mail with initial Access
ID and Password. Upon receiving the letter, Authorized Users
will need to click the “Log On” button on the Personal Online Banking
Web site to access Eligible Accounts. Once the Access ID and
Password are entered correctly, Authorized users will be prompted to
change their Access ID and Password. Immediately following the
changing of their password, Customer Authorized users will be
able to access Information or initiate Fund Transfer Requests.
Except as otherwise governing Customer’s accounts, customer is
responsible for all transfers made using user password(s) even if
Authorized User exceeds given authority. Customer’s Authorized
Users shall not make available a written record of user password(s)
and will not otherwise disclose user password(s) to anyone not
authorized to use them. Customer’s failure to safeguard user
password(s) may result in unauthorized uses, for which Customer
is fully liable. Additional precautions to protect Customer
from unauthorized use includes Customer’s sole responsibility for log
off procedures concerning Internet browsers, as well as Personal
Online Banking. Customer will contact FNB IMMEDIATELY if
it believes a breach of password(s) or Customer information have
been, or may have been used or accessed without Customer’s permission.
Customer may call FNB at 1-800-860-7340 and ask for the
supervisor in the accounting department. For further protection,
upon three unsuccessful attempts to log in, your access to the system
will be revoked and you will need to contact the bank to have your
access reestablished.
Fees
All charges will be assessed in accordance with the
Personal Online Banking Fee Schedule, and as amended from time to time
with notice to Customer. All service charges for Customer’s use
of Personal Online Banking are in addition to any normal service
charges which apply to Customer’s accounts. FNB reserves the
right to service charge Customer’s accounts for all service charges.
Customer shall be responsible for any deficiency.
Web Site Privacy
Statement
At First National Bank, the basis of each customer
relationship, many of which span generations, is trust. You have
chosen to do business with First National Bank, and we are obligated
to honor that relationship with great care, beginning with the
information you have chosen to share with us.
We believe that your privacy should not be
compromised. At the same time, we want to offer you the array of
financial produces and services you need to accomplish your financial
goals. We believe we can do both through the privacy outlined
below.
Privacy Policies
We Do Not Sell Personal Information to Anyone.
We recognize and respect the privacy expectation of
our customers and former customers and will disclose these principles
of financial privacy to our customers on a regular basis.
Collection of Customer Information
We will collect, use and retain information about
individual customers only where we believe it would be useful (an
allowed by law) to administer business and to provide products,
services and other opportunities to our customer.
Maintenance of Accurate Information
We will establish procedures to ensure that your
financial information is accurate, current and complete, in keeping
with reasonable commercial standards. We will respond to
requests to correct inaccurate information in a timely manner.
Limiting Employee Access to Information
Our privacy policy serves as a standard for all our
employees for the collection, use, retention and security of all
individual customer information. Each First National Bank employee is
required to follow our Code of Conduct Policy which states that all
customer information is considered private and privileged, and is to
be used solely on a “need to know” basis for the purpose of providing
you with the finest service available. We will take appropriate
disciplinary measures where necessary to enforce employee privacy
responsibilities.
Restrictions on the Disclosure of Account
Information
We will not reveal specific information about
customer and former customer accounts or other personably identifiable
data to unaffiliated third parties for their independent use except
for the exchange of information with reputable information reporting
agencies to maximize accuracy and security of such information or in
the performance of bona fide corporate due diligence, unless: 1) the
information is provided to help complete a customer-initiated
transaction; 2) the customer request it; 3) the disclosure is required
by/or allowed by law (e.g. subpoena, investigation of fraudulent
activity, etc.); 4) the customer has been informed about the
possibility of disclosure for marketing or similar purposed through a
prior communication and is given the opportunity to decline (i.e.,
“opt out”).
Maintaining Customer Privacy in Business
Relationships with Third Parties
If personally identifiable customer information is
provided to a third party, we will insist that the third party adhere
to similar privacy principles that keep such information confidential.
Providing Privacy Information to Customers
and Responding to Inquiries
We want our customers to understand our commitment
to privacy in our use of customer information. As a result of
our commitment, we have developed these Privacy Principles which are
made readily available to our customers. Customers who have a
question about the privacy of their customer information may call
their First National Bank Representative.
